So the President has once again made a unilateral change to
the enforcement of the Affordable Care Act – one meant to benefit him in some
way no doubt. In addition to his decision
to delay the employer mandate for medium and large businesses he has now
decided to delay enforcement of the mandatory caps on out-of-pocket costs to
individuals.
According to the New York Times, the decision to delay the
cap on costs was made because many employers said they needed to upgrade their
computer systems. The issue was they used different systems to administer both
medical coverage and drug coverage, and they were not set up to
"aggregate" all the money an individual spends out of pocket.
The decision raises concerns that, at least for next year,
the health care law will not save people as much money as President Obama
claimed. On the campaign trail, Obama has touted caps on out-of-pocket costs as
a selling point. Insurance companies
could still raise premiums to offset some of the lost revenue from caps on
out-of-pocket costs.
While there are many problems with what Max Baucus has
called a “train wreck waiting to happen” that is Obamacare, here is one of the
problems with the way it is being enforced.
According to the Constitution – that document that governs the
government, the President's role in law enforcement rests on the constitutional
requirement that the President “take Care that the Laws be faithfully
executed.” He is responsible for
enforcing all federal laws. There is
nothing in the Constitution that allows the President to pick and choose the
laws, or sections thereof, that he will or won’t enforce.
So how is it he keeps deciding which parts of the Obamacare
law he will or won’t enforce, to include delayed implementation of certain
parts of it, and our other elected officials continue to allow him to do
it? John Boehner and Mitch McConnell
should be up in arms about the President’s selective enforcement of his law but
they’re remarkably quiet.
The President and the Attorney General do the same selective
law enforcement when it comes to illegal immigrants. That’s right – I said it. ILLEGAL IMMIGRANTS – those people who enter
our country illegally and stay without legal authorization. You know – future Democrat voters.
The President likes to brag that he has deported more
illegal aliens than the Bush administration – all the while telling the Border
Patrol and other law enforcement agencies not to apprehend illegal aliens just
because they are illegal. And even
trying to prosecute people like Sheriff Joe Arpaio for “discrimination” because
he actively captures people in the country illegally. Just more selective law enforcement by this
administration.
I’m not sure when our elected officials, both on the right
and left, became such progressive wimps but I’m glad to see the handful of
conservatives who are standing up to the political establishment. Rand Paul, Mike Lee, Ted Cruz, and
occasionally Marco Rubio, (Rubio lost some of my faith over the immigration
reform bill.) Unlike has-beens such as
John McCain and Lindsay Graham, they’re standing on conservative principles and
looking out for the country and the people rather than for their own
(progressive) interests. Of course, the
Republican establishment is fighting them all the way – to the detriment of the
nation.
For several years now I have identified myself as a
conservative rather than a Republican.
Some will say they are one in the same but they are definitely wrong
about that. The Republican Party has
swung very far toward the progressive (liberal) side in the last 20 years. It’s no longer the party of Ronald Reagan. In fact – Reagan wouldn’t even recognize it
these days.
Mr. President – please stop enforcing laws to your own
satisfaction and stick to that document you supposedly taught at University of
Chicago. If you taught Constitutional
law you really should have at least some of it memorized by now. If you can’t follow the Constitution and
enforce the laws of the land as required maybe you should step down. Just sayin’….
